CNESST Death Benefit Financial Compensation for Work-Related Fatalities
If a loved one passes away due to a work-related accident or illness, the Commission des normes, de l'équité, de la santé et de la sécurité du travail (CNESST) offers financial compensation to eligible survivors. Depending on the circumstances, the benefit may be paid as a monthly pension or a lump-sum payment.
This program is designed to ease the financial burden on families affected by a sudden, work-related loss.
Compensation for Spouse and DependentsIf the deceased worker had a spouse, they may receive a minimum lump-sum benefit of $133,354, indexed annually. This amount helps the spouse cover unexpected expenses related to the death.
If there is no spouse, the amount is distributed equally among other dependents.
Dependents are defined by CNESST as:
The spouse of the deceased
A minor child
A full-time student under 25
A disabled child under 25
Any person whose basic needs were at least 10% financially covered by the worker
If the deceased had no dependents, the benefit may be paid to one parent or, if both are deceased, to the worker’s estate.
Funeral and Transportation Costs Covered
The CNESST reimburses funeral expenses up to $6,842, along with transportation costs for the body, to the person who paid for these services, provided supporting documents are submitted.
Eligibility and Time Limit to File a ClaimTo be eligible for the death benefit, the claim must be submitted:
Within 6 months of the death, or
Within 6 months of discovering that the death was work-related.
If no claim is made within 7 years of the date of death, the right to compensation is permanently lost.
